Lay hypnotists, however, have been battling for legitimacy in Texas for years, often using the "no harm" argument to gain a legal foothold. But in 1993, the Legislature redefined the practice of psychology to include the use of "hypnosis and hypnotherapy for health-care purposes." If questions arise as to whether a lay hypnotist has entered into a therapeutic relationship with a client, he can now be prosecuted for practicing psychology without a license.
Because the Texas Board of Examiners of Psychologists, the state agency that regulates the profession, is understaffed and only acts on filed complaints, the practice of hypnosis has become so unregulated that the state has become a certificate mill for lay hypnotists with little training or experience. The contention that these hypnotists "do no harm" still rankles professional hypnotherapists who see the proliferation of lay hypnotists as something akin to a social ill.
Wishing to open a disucssion on the topic of where the line between "Practicing Psychology Without A License" and "Hypnotherapy" is drawn. HypnoTHERAPY .. entering into a THERAPUTIC relationship with a client equals practicing Psychology without a license... (??

Interesting observation.-- Indiana has passed a new law reguarding hypnotists. Hypnotists must be certified, by the state medical board, under the health professions bureau.
Pschology is a broard term. Many who prctice it have little or NO training in hypnosis. IMHO education is the key. I would prefer A heart specialist do my catherization instead of a proctologist, and would NOT want an untrained psychologist offering hypnotherapy just because he/she IS a psychlogist.
the father of pyscholgy, who was a drug addict and had sexual fantacies about his mother, is not the type of person I would model my practice after.

It is my untrained legal understanding that the Texas Law has been interperted by the Texas Attorney General, who offered the opinion stated in the article. However, in a totally separate case the Texas Supreme Court has found that the opinion of the Attorney General is just that, an opinion and not law. In other words this wording of the law is untested.
It is also my understanding that to this date no hypnotit has been arrested, much less convicted of practicing psychology without a license.

The phrase ALTERNATIVE THERAPY sometimes best describes Hypnotherapy and in these terms Reflexology can also be linked.
As an alternative therapy,psychology, is often replaced by the word
PSYCHOTHERAPY---consequently a HYPNOTHERAPIST who uses PSYCHOTHERAPY, should not fall into the restrictive guidelines that TEXAS has to offer.
At the end of the day most Hypnotherapists are working towards helping people in an alternative way, and should not be over restricted.
